"Par izmaiņām Latvijas Republikas, Igaunijas Republikas un

Lietuvas Republikas brīvās tirdzniecības nolīguma A protokolā"

1.pants. 1999.gada 25.novembrī pieņemtā Latvijas Republikas, Igaunijas Republikas un Lietuvas Republikas brīvās tirdzniecības nolīguma Apvienotās komitejas rezolūcija Nr.1/1999 "Par izmaiņām Latvijas Republikas, Igaunijas Republikas un Lietuvas Republikas brīvās tirdzniecības nolīguma A protokolā" (turpmāk – Rezolūcija) ar šo likumu tiek pieņemta un apstiprināta.

2.pants. Likums stājas spēkā nākamajā dienā pēc tā izsludināšanas. Līdz ar likumu izsludināma Rezolūcija latviešu un angļu valodā.

3.pants. Rezolūcija stājas spēkā tās 2.pantā noteiktajā laikā un kārtībā, un Ārlietu ministrija par to paziņo laikrakstā "Latvijas Vēstnesis".

par izmaiņām 1993.gada 13. septembrī parakstītajā brīvās tirdzniecības nolīgumā starp Latvijas Republiku, Igaunijas Republiku un Lietuvas Republiku A Protokolā,

 

APVIENOTĀ KOMITEJA,

Atsaucoties uz 1993. gada 13.septembrī parakstīto brīvās tirdzniecības nolīgumu starp Latvijas Republiku, Igaunijas Republiku, Lietuvas Republiku un 1997.gada 6.februārī parakstīto Apvienotās komitejas Rezolūciju Nr. 1/1997 par labojumiem brīvās tirdzniecības nolīguma starp Latvijas Republiku, Igaunijas Republiku, un Lietuvas Republiku A protokolā, un 1998.gada 22.decembrī parakstīto Apvienotās komitejas Rezolūciju Nr. 1/1998 par labojumiem brīvās tirdzniecības nolīguma starp Latvijas Republiku, Igaunijas Republiku, Lietuvas Republiku A protokolā;

Ņemot vērā brīvās tirdzniecības nolīguma starp Latvijas Republiku, Igaunijas Republiku, Lietuvas Republiku (turpmāk tekstā Nolīgums) 24.panta nosacījumus;

Ievērojot to, ka termina “izcelsmes produkti” definīcija ir jāmaina, lai nodrošinātu paplašinātās kumulācijas sistēmas, kas pieļauj Eiropas Kopienas, Polijas, Ungārijas, Čehijas Republikas, Slovākijas Republikas, Bulgārijas, Rumānijas, Latvijas, Igaunijas, Lietuvas, Slovēnijas, Turcijas, Islandes, Norvēģijas un Šveices (ieskaitot Lihtenšteinas) izcelsmes materiālu lietošanu, atbilstošu darbību;

Ievērojot to, ka būtu vēlams mainīt pantu formulējumus, kas attiecas uz summām, lai pilnībā ņemtu vērā eiro stāšanos spēkā;

Ievērojot to, ka jāprecizē apstrādes un pārstrādes noteikumu saraksts, kas jāizpilda neizcelsmes materiāliem, lai tie iegūtu izcelsmes statusu, ņemot vērā izmaiņas pārstrādes metodēs un atsevišķu izejmateriālu trūkumu,

 

IR NOLĒMUSI SEKOJOŠO:

  1. pants

Protokols A par “izcelsmes produktu” jēdziena definējumu un administratīvās sadarbības metodēm tiek mainīts sekojoši:

  1. 21. un 26. pantā nosaukums “ECU” tiek aizvietots ar “eiro”.
  2. 30. pants tiek aizvietots ar:

“30. pants

Eiro izteiktās summas

  1. Eksportējošās Puses nacionālajā valūtā izteiktās summas, kuras ir ekvivalentas eiro izteiktajām summām, jābūt fiksētām eksportējošā Pusē un paziņotām importējošai Pusei.
  2. Ja summas pārsniedz atbilstošās summas, kuras fiksē importējošā Puse, pēdējai tās ir jāpieņem, ja rēķins par produkciju ir izskatīts eksportējošās Puses valūtā. Ja rēķins par produkciju ir izrakstīts kādas citas Puses valūtā, kas uzskaitīts 4.pantā, tad importējošā Puse atzīst un pieņem attiecīgās Puses paziņoto summu.
  3. Summām, kas tiek minētas jebkurā tādā nacionālajā valūtā, jābūt ekvivalentām ar šajā nacionālajā valūtā izteiktām summām eiro izteiksmēm uz 1999. gada oktobra pirmo darba dienu.
  4. Eiro izteiktās summas un to ekvivalenti nacionālajās Pušu valūtās tiek pārskaitītas Apvienotajā komitejā pēc Puses pieprasījuma. Veicot šo pārskatīšanu, Apvienotajai komitejai jāraugās, lai nenotiktu jebkurā nacionālajā valūtā lietoto summu samazinājums un jāapsver attiecīgo ierobežojumu saglabāšanu reālā izteiksmē. Šim mērķim tā var nolemt mainīt eiro izteiktās summas.”

 

 

 

 

 

 

 

 

3. II Pielikums tiek papildināts ar sekojošo:

 

  1. HS preču pozīciju 1904 ir jāaizvieto ar sekojošo:
  2. 1904

    Gatavi pārtikas produkti, kas iegūti, uzpūšot vai apgrauzdējot graudus vai graudu produktus (piemēram, kukurūzas pārslas); graudaugi (izņemot kukurūzu) graudu vai pārslu veidā vai citā veidā apstrādāti graudi (izņemot miltus un rupja maluma miltus), pirms tam vārīti vai sagatavoti ar citu paņēmienu, kas citur nav minēti

    Ražošana, kurā:

    - neizmanto 1860 grupas materiālus;

    - kurā visai izmantotajai labībai un miltiem (izņemot ziemas kviešus un to atvasinājumus) jau ir izcelsme pilnībā ¹

    - kurā visu 17. grupas izmantoto materiālu vērtība nepārsniedz 30% no produkcijas ex –works cenas

     

    1 Izņēmumi attiecībā uz Zea indurata maize ir pielietojami līdz 31.12.2002.

     

  3. HS preču pozīciju 2207 ir jāaizvieto ar sekojošo:

2207

Nedenaturēts etilspirts ar spirta tilpumkoncentrāciju 80% vai vairāk; etilspirts un pārējie jebkura stipruma spirti, denaturēti

Ražošana:

  • visus izmantotos materiālus klasificē pozīcijā citā kā 2207 vai 2208;
  • visām vīnogām vai visiem materiāliem , kas atvasināti no vīnogām, jābūt izcelsmei pilnībā, vai ja visi pārējie produkti jau ir izcelsmes, araku drīkst lietot līdz 5% no tilpuma
 

 

  1. HS preču pozīciju 57 ir jāaizvieto ar sekojošo:

57. grupa

Paklāji un pārējās tekstila grīdsegas:

  • No adatu cauršūtā filca

Ražošana no1:

  • dabīgajām šķiedrām ,vai
  • ķīmiskiem materiāliem vai tekstila pulpas

Tomēr var izmantot:

  • 5402 pozīcijā klasificēto polipropilēna pavedienu,
  • 5503 vai 5506 pozīcijā klasificētos polipropilēna pavedienus,vai

- 5501 pozīcijas polipropilēna pavedienu grīstes, kuru lineārais blīvums visos monopavediena vai šķiedras gadījumos ir mazāks par 9 decitekiem, nodrošinot, ka to vērtība nepārsniedz 40% no produkcijas ex – works cenas

Džutas audumi var tikt izmantoti oderējumam

 
 

  • No pārējā filca

Ražošana no1:

- nekārstām vai neķemmētām vai citādi neapstrādātām dabīgām šķiedrām,

- ķīmiskiem materiāliem vai tekstila pulpas

 
 

  • No citiem tekstila materiāliem

Ražošana no1:

- kokosšķiedras dzijas vai džutas dzijas,

- sintētiskās vai mākslīgās pavedienu dzijas,

  • dabīgajām šķiedrām, vai

- nekārstām vai neķemmētām vai citādi vērpšanai neapstrādātām sintētiskām štāpeļšķiedrām,

Džutas audumi var tikt lietoti oderējumam

  1. HS preču pozīciju 8401 ir jāaizvieto ar sekojošo:

    Kodolenerģijas elementi

    Ražošanā, kurā visus izmantotos materiālus klasificē pozīcijā, citā kā produkcijai1

    Ražošana, kurā visu izmantoto mat. vērtība nepārsniedz 30% no produkcijas ex-works cenas

    1 Šo noteikumu ir jāpiemēro līdz 2005.g. 31. decembrim.

     

     

     

     

     

     

     

     

  3. starp HS preču pozīciju 9606 un 9612 ir jāiestarpina sekojošais:

Lodīšu pildspalvas; pildspalvas un marķieri ar filca vai cita poraina materiāla uzgali; tintes pildspalvas, stilogrāfi un pārējās pildspalvas, kopēšanas spalvas, izbīdāmie skrūvveida zīmuļi vai slīdzīmuļi, pildspalvu turētāji, zīmuļturētāji un līdzīgi turētāji, iepriekšminēto izstrādājumu daļas (ieskaitot uzgales un saspraudes), izņemot 9609. preču pozīcijas izstrādājumus

Ražošana, kurā visus izmantotos materiālus klasificē pozīcijā, citā kā produkcija. Tomēr rakstāmspalvas var klasificēt tajā pašā preču grupā

 

 

 

  1. pants

Šī Rezolūcija stājas spēkā nākošā mēneša pirmajā dienā pēc tam, kad visas Puses ir paziņojušas Depozitārijam par nepieciešamo iekšējo procedūru pabeigšanu, lai šī Rezolūcija stātos spēkā.

Šī Rezolūcija ir pagaidu piemērošanā no 2000.gada 1.janvāra.

Rezolūcija ir jādeponē 1993.gada 13.septembrī parakstītā brīvās tirdzniecības nolīguma starp Latvijas Republiku, Igaunijas Republiku un Lietuvas Republiku Depozitārijā Igaunijas Republikā.

APLIECINOT IEPRIEKŠ MINĒTO attiecīgas pilnvarotās personas ir parakstījušas šo Rezolūciju.

PARAKSTĪTA Tallinā tūkstoš deviņi simti deviņdesmit devītā gada 25. novembrī vienā eksemplārā angļu, latviešu, lietuviešu un igauņu valodās. Domstarpību gadījumā noteicošais teksts ir angļu valodā.

Resolution No 1/1999

 

On the changes of Protocol A to the Free Trade Agreement between the Republic of Estonia, the Republic of Latvia and the Republic of Lithuania signed on September 13, 1993

 

THE JOINT COMMITTEE,

making reference to the Free Trade Agreement between the, the Republic of Estonia, the Republic of Latvia and the Republic of Lithuania, signed on September 13, 1993 and the amendments to Protocol A of the Free Trade Agreement between the Republic of Estonia, the Republic of Latvia and the Republic of Lithuania signed on February 6, 1997 by the Resolution of the Joint Committee No 1/1997 and as well as amendments to Protocol A of the Free Trade Agreement between the Republic of Estonia, the Republic of Latvia and the Republic of Lithuania signed on December 22, 1998 by the Resolution of the Joint Committee No 1/1998;

making reference to Article 24 of the Free Trade Agreement between, the Republic of Estonia, the Republic of Latvia and the Republic of Lithuania (hereinafter referred to as Agreement);

Whereas the definition of the term "originating products" needs to be amended to ensure the proper operation of the extended system of cumulation which permits the use of materials originating in the European Community, Poland, Hungary, the Czech Republic, the Slovak Republic, Bulgaria, Romania, Latvia, Estonia, Lithuania, Slovenia, Turkey, Iceland, Norway and Switzerland (including Liechtenstein);

Whereas it would seem advisable to revise the Articles concerning the amounts in order to fully take into consideration the entry into force of the euro;

Whereas, to take account of changes in processing techniques and shortages of certain raw materials, some corrections must be made to the list of working and processing requirements which non-originating materials have to fulfil to quality for originating status,

 

HAS DECIDED AS FOLLOWS:

 

 

 

 

 

 

 

 

Article 1

 

Protocol A concerning the definition of the concept of “originating products” and methods of administrative co - operation is hereby amended as follows:

  1. In Articles 21 and 26 the word “ECU” shall be replaced by “euro”.

  1. Article 30 shall be replaced by the following:

“Article 30

Amounts expressed in euro

  1. Amounts in the national currency of the exporting country equivalent to the amounts expressed in euro shall be fixed by the exporting country and communicated to the importing country.
  2. When the amounts exceed the corresponding amounts fixed by the importing country, the latter shall accept them if the products are invoiced in the currency of the exporting country. When the products are invoiced in the currency of another country referred to in Article 4, the importing country shall recognise the amount notified by the country concerned.
  3. The amounts to be used in any given national currency shall be the equivalent in that national currency of the amounts expressed in euro as at the first working day of October 1999.
  4. The amounts expressed in euro and their equivalents in the national currencies of Latvia, Estonia and Lithuania shall be reviewed by the Joint Committee at the request of Latvia, Estonia or Lithuania. When carrying out this review, the Joint Committee shall ensure that there will be no decrease in the amounts to be used in national currency and shall furthermore consider the desirability of preserving the effects of the limits concerned in real terms. For this purpose, it may decide to modify the amounts expressed in euro.”

3. Annex II shall be amended as follows:

(a) the entry for HS heading 1904 shall be replaced by

Prepared foods obtained by the swelling or roasting of cereal or cereal products (for example, corn flakes); cereals (other than maize (corn)) in grain form or in the form of flakes of other worked grains (except flour and meal), pre-cooked; or otherwise prepared, not elsewhere specified or included

Manufacture:

- from materials not classified within heading No1806;

- in which all the cereals and flour (except durum wheat and its derivatives and Zea indurata maize) used must be wholly obtained;1

- in which the value of any materials of chapter 17 used does not exceed 30 % of the ex – works prise of the product

 

1 The exception concerning the Zea indurata maize is applicable until 31.12.2002.

(b)the entry for HS heading 2207 shall be replaced by:

 

 

2207

Undenatured ethyl alcohol of an alcoholic strength by volume of 80% vol or higher; ethyl alcohol and other spirits, denatured, of any strength

Manufacture:

- from materials not classified within heading Nos2207 or 2208;

- in which all the grapes or any material derived from grapes used must be wholly obtained or if all the other materials used are already originating, arrack may be used up to a limit of 5% by volume

 

 

 

(c) the entry for HS Chapter 57 shall be replaced by:

 

 

Chapter 57

Carpets and other textile floor coverings:

- Of needleloom felt

Manufacture from1:

- natural fibres

or

- chemical materials or textile pulp

However:

- polypropylene filament of heading No5402, or

- polypropylene fibres of heading Nos5503 or 5506,

or

- polypropylene filament tow of heading No5501, of which the denomination in all cases of a single filament of fibre is less than 9 decitex,

may be used provided their value does not exceed 40% of the ex-works price of the product

Jute fabric may be used as backing

 
 

- Of other felt

Manufacture from1:

- Natural fibres not carded or combed or otherwise processed for spinning,

Or

- Chemical materials or textile pulp

 
 

- Of other textiles materials

Manufacture from1:

- Coir or jute yarn,

- Synthetic or artificial filament yarn,

- Natural fibres, or

- Man-made staple fibres not carded or combed or otherwise processed for spinning

Jute fabric may be used as backing

 

1 For special conditions relating to products made of a mixture of textile materials, see Introductory Note 5.

 

 

(d) the entry for HS heading 8401 shall be replaced by:

Ex 8401

Nuclear fuel elements

Manufacture in which all the materials used are classified within a heading other than that of the product1

Manufacture in which the value of all the materials does not exceed 30% of the ex-works price of the final product

This rule shall apply until 31 December 2005.

 

 

(e) the following shall be inserted between the entries for HS heading Nos9606 and 9612:

9608

Ball-point pens; felt-tipped and other porous-tipped pens and markers; fountain pens, stylograph pens and other pens; duplicating stylos; propelling or sliding pencils; pen-holders, pencil-holders and similar holders; parts (including caps and clips) of the foregoing articles, other than those of heading No9609

Manufacture in which all the materials used are classified within a heading other than that of the product. However, nibs or nib-points classified within the same heading may be used

 

 

 

 

 

 

Article 2

 

This Resolution shall enter into force on the first day of the second month after all the Parties have notified the Depositary of completing the internal legal procedures necessary for the entry into force of this Resolution

The Resolution shall be applied provisionally from1 January 2000.

This Resolution shall be deposited with the Depositary of the Free Trade Agreement between the Republic of Estonia, Republic of Latvia and the Republic of Lithuania signed on 13 September, 1993, the Republic of Estonia.

 

 

 

IN WITNESS WHEREOF the undersigned plenipotentiaries, being duly authorised thereto, have signed this Resolution.

 

DONE at Tallinn, this 25 day of November, one thousand nine hundred and ninety nine in one copy in the English, Estonian, Latvian, Lithuanian languages. In case of divergence the English text shall prevail.
